ORDERS
If you wish to purchase any product or service made available through the Websites or via Phone (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Tracking Orders
Once your order has shipped, you will receive a confirmation email with your tracking number.
Payment Method
Please note there is a $25 order minimum excluding shipping costs. For your convenience, Pliant will accept VISA, MasterCard, and American Express. Your credit card is billed/credited at the time the order is verified/shipped. There is no surcharge for using your credit card to make purchases within Pliant. Please be sure to provide your exact billing address and billing telephone number, which your credit card issuer has on file for you. Incorrect information may cause a delay in processing your order. Pliant reserves the right to accept or decline any order for any reason.
Tax Policy
Pliant collects sales tax for delivery to all addresses within the state of Alabama and California.
Shipping Options
Pliant uses FedEx for all orders placed. During the checkout process, you will have the option to obtain a shipping quote prior to placing your order. Shipping charges are automatically calculated for you when placing your order. Total shipping charges are calculated based on the quantity and model of product(s) you order. All duties, customs, and taxes are the responsibility of the customer.
All orders placed with Pliant are subject to a 24-48 hour processing period prior to shipment. Pliant does not ship on Saturday, Sunday or holidays. Note: Pliant cannot deliver to P.O. Boxes, APO or FPO addresses. All shipments are subject to stock availability.
Mis-Shipment Policy
Pliant provides you with full shipment insurance for your purchase, included in the shipping and handling fee when shipped and billed through Pliant. However, you are responsible for providing accurate information on the Account Registration and/or Order Forms. Please double-check and confirm that you provided accurate shipping address and daytime phone number.
If the shipper loses the package, due to customer entry error, then it becomes customer’s responsibility to provide the accurate information to the shipper. If the shipper is at fault, and the problem is not resolved within 10 business days, Pliant will ship a replacement product to you immediately. This policy only applies to products being shipped from Pliant to the customer.
Missing Material Policy
Pliant will supply materials missing from your product packages (for example, software, manuals, cards, cables, etc.) if you notify us within 60 days of receipt of order. Please call Pliant at +1-334-321-1160, 8 a.m. to 5 p.m. CST, Monday through Friday; for replacement materials. After 60 days of receipt of order, it will be your responsibility to purchase replacement materials by calling Pliant Customer Service at +1-334-321-1160 or emailing [email protected] 8 a.m. to 5 p.m. CST, Monday through Friday (excluding weekends and holidays).
CANCELLATIONS AND RETURNS
Order Changes / Cancellation
We apologize, but we are not able to make any changes or to cancel your order once it has been submitted to us for processing. You may return any products by following our Return Policy.
Note: Most parts are shipped from our inventory. If a part is back ordered, you will receive a notification from our customer service department. Occasionally we may have to cancel an order or product due to processing reasons. If so, you will be notified via email. You will not be charged for cancelled products.
Return Policy
All of the products found on Pliant come with 30-day Return Policy and a 20% restocking fee will be charged unless the item is defective or damaged. Shipping and handling will not be refunded. Customer is responsible for sending product back to Pliant. After the 30 day return policy period has ended, support for defective products will be provided by our technical support group ([email protected]).
Please refer to the following instructions before sending your original item back:
- If your product(s) become(s) defective, or you wish to return or exchange your product(s), within the first thirty (30) days of your invoice date, you may return it for a refund, or a no charge repair, subject to restrictions. Before returning any item, please refer to and provide the following information when requesting a replacement: (refer to packing slip).
- Order Number
- Bill-to zip code
- Bill-to phone number
- Your daytime phone number
- In order to return merchandise, you must email [email protected] for a Return Merchandise Authorization (RMA) within thirty days of your invoice date.
- No returns, of any type, will be accepted without an RMA number. Please be sure to physically inspect your Pliant product(s) before opening any bundled software. For defective software, the Pliant Web Store authorizes same-item exchange only.
- The RMA number is good for only one (1) purchase transaction and must match the product authorized for return.
- All products (unless noted on the Pliant site or by Pliant) are sold with the full manufacturer’s warranty.
- You are responsible for shipping and insurance charges related to the return of the original product(s). In order to receive full credit, return your product after obtaining an RMA. All items must be in “as-new” condition, in original packaging and with all warranty cards, manuals and accessories. Any missing items could result in a delay or partial forfeiture of your credit. There will be a $25.00 re-box fee for products returned in a damaged box, or returned in a non-original box.
- All items being returned must be received in the Pliant warehouse within 10 business days (two calendar weeks) of receipt of your RMA number and return instructions. Any discrepancies could result in a delay or complete forfeiture of your credit.
- Pliant will ship a replacement or exchange product(s) upon receipt of the returned product(s). You might not need to offer a credit card number for this option. Pliant will pay for the shipping charges necessary for you to return the defective product(s) within 30 days from purchase date.
Pliant will refund or credit your charge card for the value of the product. Shipping and handling charges are non-refundable and we do not pay for shipping on returns except in the case of DOA or defective parts. Please allow two billing cycles for the credit to appear on your credit card statement. Pliant will not be responsible for any interest accrued, fees, etc., which may be charged to your credit card during the credit processing period.
AVAILABILITY, ERRORS AND INACCURACIES
We are constantly updating our offerings of products and services on the Websites. The products or services available on our Websites may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Websites and in our advertising on other web sites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Important information regarding the use of this site. Pliant is committed to ensuring the privacy of your personal information and this privacy notice is designed to tell you which information we collect from you, how this information may be used and how it is protected.
Which personal data do we collect?
Types of data that we collect for specified purposes are: your name, phone number, job role, country of residence, physical/shipping addresses, credit-card information, a description of the item requested or purchased, business data related to the implementation of standards, IP address, and email address.
This information may include:
- Information You Give Us. We collect your name, job role, addresses, user name, email address, password, country of residence, as well as other information you directly give us on Pliant’s websites, through contact us forms, request for quotes, emails, promotions/contests, applications, and general correspondence.
- Information Automatically Collected. We automatically log information about you and your device. For example, when using Pliant’s web site, we log your IP address, operating system type, browser type, the referring website, pages you viewed, and access times. We also collect information about actions you take when using Pliant’s web sites, such as pages visited and time spent on pages, etc.
- Cookies. We may log information using “cookies.” Cookies are small data files stored on your device by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them). We do not currently respond to Do Not Track signals.
Purpose and manner of personal data collection and use
Pliant collects and processes personal data in accordance with the provisions of the Personal Data Protection Act and other regulations in force in the Republic of Croatia and the European Union.
Your personal data are processed only on the basis of your approval a free and express consent to process your personal data for the purposes related to the use of the Content available through the Websites. Your consent for the collection and processing of your personal data for a given purpose shall be requested when completing the appropriate form published on the Websites.
Your personal data shall be used in order to reply to queries concerning the Content available on the Websites, and inform you about the existing and new content, materials, functionalities, services and other offers that may interest you, and in order to improve the quality of the Content and the Websites.
Data collected through questionnaires are confidential and may be used only for our own purposes.
All collected data are electronically stored, and appropriate measures and procedures are applied in order to prevent unauthorized access, maintain the level of personal data protection and use the data collected online in a correct manner.
Even though we take all appropriate measures to ensure against unauthorized disclosure of your personal data, we cannot guarantee that some of the collected personal data shall never be disclosed in a manner that is not in accordance with these Terms. Accidental disclosure may be, for example, a consequence of false misrepresentation when accessing websites that contain such data, with the purpose of correcting possible errors in the data. We shall not be liable, to the fullest extent permitted by law, for any damage caused to users or third parties relating to accidental disclosure of personal data.
Navigation Information
Even if you do not make a purchase on our site, we have the ability to track usage of our web site – including the server from which the site was visited. This information is not used to track information about individuals, but is used on an aggregate level to customize our site and improve the on-line experience.
Information Voluntarily Provided
There are times when you may provide information to us voluntarily. This occurs when you provide your feedback to us though e-mails, return forms, letters or telephone calls. We use this information to respond to your query and to keep track of customer feedback.
Internet Database
Pliant has created an Internet database to allow consumers to store their shipping and billing information, track the status of their order, list previous orders and retain email preferences. Registration is entirely voluntary and you have the ability to correct or delete the information at any time. This information is accessed through the “My Account” section of the site.
Transaction Security
In order to make every effort to ensure that your experience with Pliant is secure, we use encryption technology to protect you against the loss, misuse or alteration of your personal information. When you fill out any contact forms or access your account, a secure server encrypts all of your information through the use of Secure Socket Layers (SSLs).
Pliant WebStore Safe Shopping
We guarantee that every online transaction you make will be 100% safe. This means you pay nothing if unauthorized charges are made to your card as a result of shopping at Pliant. Under the Fair Credit Billing Act (FCBA), your bank cannot hold you liable for more than $50.00 of fraudulent charges. For more information on the FCBA, visit http://www.ftc.gov/. We will only cover this liability if the unauthorized use of your credit card resulted through no fault of your own from purchases made while using the secure server. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.
Communication and disclosure of personal data to third parties
Your personal data shall not be disclosed to third parties without your express consent, except under legal obligation. More specifically, your personal data shall not be transmitted or provided to third parties outside the European Union without your express consent, except under legal obligation.
The personal data you provided may be transmitted to our related companies and/or partners when this is deemed necessary for the purpose of maintaining and managing the Websites and for the purpose of provisioning our products and services. In such cases, we shall ensure that our partners and/or related companies take over the responsibility to protect personal data to an extent equal to that guaranteed in these Terms.
Your personal data (including your email) will never be shared with any third parties for marketing purposes.

Delete personal data. In certain situations, for example when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your data.
You are legally entitled to request modification or deletion of your personal data, or deletion from the registered user database at any time. Modification or deletion of data shall be effected on the basis of an appropriate notice addressed to the contact identified on the Websites.
In your request, please make clear (a) what personal information is concerned, and (b) which of the above rights you would like to enforce. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will only process your personal information in accordance with applicable data protection and privacy laws. We need certain personal information in order to provide you with access to Pliant website. If you do not agree to our use of your personal information in line with this Policy, please do not use Pliant’s website(s).

We ask that you not send us, and you do not disclose, any sensitive personal data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through Pliant’s website(s) or otherwise to us.

We often receive testimonials and comments from users who have had positive experiences with our products and services, and we occasionally publish them. We obtain the user’s consent prior to posting any feedback on a public area of the Site.
We reserve the right to use cookies.
A cookie is a group of data serving as your anonymous individual identifier that is sent to your browser by websites. Cookies are sent when you access a website, they are stored in your computer and they serve to record information about your subsequent online visits. Therefore, after a cookie has been stored on your computer during your first access to a website, every time you return to the website it will look for its cookie in order to read the stored data.

WARRANTY TERMS AND CONDITIONS
Limited Warranty Pliant products are warranted to be free from defects in materials and workmanship for a period of two years from the date of sale. The sole obligation of Pliant Technologies, LLC during the warranty period is to provide, without charge, parts and labor necessary to remedy covered defects appearing in products returned prepaid to Pliant. This warranty does not cover any defect, malfunction or failure caused by circumstances beyond the control of Pliant, including but not limited to unreasonable or negligent operation, abuse, accident, failure to follow instructions in the User Manual, defective or improper associated equipment, attempts at modification and/or repair not authorized by Pliant, inbound shipping, and shipping damage. Products with their serial numbers removed or effaced are not covered by this warranty. This limited warranty is the sole and exclusive express warranty given with respect to Pliant products. It is the responsibility of the user to determine before purchase that this product is suitable for the user’s intended purpose. ANY AND ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY ARE LIMITED TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. NEITHER PLIANT NOR ANY DEALER WHO SELLS PLIANT PRODUCTS IS LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND.
GOVERNING LAW
These Terms, conditions and your use of our services are governed by, and will be construed solely in accordance with, the internal laws of the State of Alabama. Any action brought under or in connection with this Agreement must be instituted in the state or federal forum covering the defending party’s principal place of business. In any such action, the prevailing party’s reasonable legal fees will be paid by the other party.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Websites and supersede and replace any prior agreements we might have between us regarding the Websites.
